The Fight Over Greg Abbott's Musk Emails Goes to a Hearing Monday, the Day Before Election Day

A Travis County judge ordered Abbott's office to let Gina Hinojosa review his unredacted communications with Elon Musk's Texas companies; the 15th Court of Appeals froze the order, and the case is heard November 2 — as Kalshi prices Abbott at 65 percent.

The Texas governor's race has a court date on its last full day. Gina Hinojosa's lawsuit over Gov. Greg Abbott's communications with Elon Musk's Texas companies is set for a hearing on Monday, November 2, the day before Election Day, according to Kalshi News' account of the court fight, read in full this cycle. The records dispute began in 2025, when The Texas Newsroom requested the communications and Abbott's office released 1,374 pages — all but about 200 of them fully blacked out, some withheld as intimate and embarrassing, the account says.

Hinojosa requested the same records in September under the Texas Public Information Act, arguing that as a sitting legislator she is entitled to inspect them confidentially, and sued on October 19, the first day of early voting, after the office refused. On Monday, Travis County District Judge Catherine Mauzy ordered the office to let her review the unredacted records by 10 a.m. Thursday under a confidentiality agreement barring disclosure, CBS Austin reported. Abbott appealed immediately, and on Tuesday the 15th Court of Appeals — whose three justices were all appointed by Abbott — froze the order, KUT reported.

Both campaigns are fighting over the fight itself. "Abbott should release the emails," Hinojosa said, adding that Texans "deserve to know what Abbott is fighting so hard to keep hidden." Abbott spokesman Andrew Mahaleris called the case "a sham lawsuit in a rigged district court," and the governor's general counsel accused Hinojosa of handpicking a judge who contributed $500 to her campaign in June; her spokesman Tommy Kubitschek answered, in a statement to Bloomberg Law: "If they are worried about $500, just wait until they find out what $5.5 million bought Musk." The account notes Musk was Abbott's largest donor in the latest reporting period, including a fresh $5 million. Kalshi's governor market prices Abbott at 65 percent to Hinojosa's 36, with more than $8.5 million traded — a market forecast, carried as such.
